Helping You Care for the Financial Needs of Your Children
After separation or divorce, ensuring your child’s financial needs are met can quickly become a source of tension. Even when both parents want to contribute fairly, disagreements can arise over payment amounts, special expenses, or changing financial circumstances. Navigating these obligations, while protecting your child’s well-being, can be legally complex and emotionally draining without the right support.
At Kirk Montoute Dawson LLP, we help parents understand their rights and responsibilities under Alberta’s child support laws. Whether you’re negotiating a new child support agreement, modifying an existing one, or facing enforcement issues, our Calgary child support lawyers work with you to achieve practical, fair solutions, including through out-of-court options such as mediation. We focus on creating child-focused arrangements that reflect your family’s unique circumstances and minimize unnecessary conflict.
“It was with great relief when I came to understand that the entire team of Kirk Montoute Dawson LLP was behind me. While I had one lawyer designated to represent my situation, I had a world of wisdom, knowledge and expertise available for consultation in the other lawyers.”~T
Legal Guidelines For Determining Child Support
Calculating basic child support payments is determined by Section 3 of the Federal Child Support Guidelines. Basic child support payments are based on the paying parent's income and the number of children he or she must support. A court can order a different amount if the paying parent's income is more than $150,000. When the non-primary parent cares for the children more than 40 percent of the time, his or her child support payment obligations may be reduced. Parents who are required to pay child support should be aware of the guidelines outlined in the Federal Child Support Guidelines.
In addition to basic child support, parents should share expenses for special and extraordinary expenses incurred on behalf of the child.
According to Section 7 of the child support guidelines, special and extraordinary child support expenses may include:
- Uninsured medical expenses
- Medical and dental insurance premiums
- Physical therapy
- Psychological counselling
- Educational expenses
- Extracurricular activities
