Calgary Probate Lawyers
Meeting The Needs Of Families
After a loved one passes, families are left with the task of caring for his or her estate and personal effects. Even an individual appointed as executor (or "Personal Representative") may be confused about the next steps he or she is required to take from a legal perspective. At Calgary's Kirk Montoute Dawson LLP, we are here to provide assistance and guidance through the lengthy and often difficult process of probate and estate administration.
Probate Application And Fulfilling Executor Duties
In Alberta, the process of receiving grant of probate typically takes two to four months. In order to grant probate, a court must be convinced that the will is valid, it is the most recent version and the named executor has the capacity to fulfil his or her duties, including the distribution of assets.
Once probate is granted, an executor must fulfil several legal obligations towards the estate. These include filing income taxes, paying creditors and dealing with disputes among beneficiaries. In some cases, the beneficiaries can demand that the executor "pass accounts," or give an accounting of all receipts and payments from the estate. Finally, the estate assets must be distributed to the beneficiaries. The process can be daunting. Our lawyers at Kirk Montoute Dawson LLP assist executors in carrying out the wishes of the deceased.
Commitment To Effective Resolution Of Disputes
Kirk Montoute Dawson LLP is a Calgary firm of lawyers, mediators and arbitrators. We are committed to dispute resolution that keeps families out of court. We represent our clients in litigation and in alternative dispute resolution processes that seek sound solutions that minimize expense and do not work to exacerbate conflict.
Estate Administration Questionnaire
Please review and fill out this form if you are in the process of administrating an Estate. The information collected will be required by your estate lawyer and/or your Personal Representative when applying for a Grant of Probate or a Grant of Administration. You must have a Grant of Probate or a Grant of Administration in order to distribute the property of an Estate.
