In Alberta, the process of receiving grant of probate typically takes two to four months. In order to grant probate, a court must be convinced that the will is valid, it is the most recent version and the named executor has the capacity to fulfil his or her duties, including the distribution of assets.
Once probate is granted, an executor must fulfil several legal obligations towards the estate. These include filing income taxes, paying creditors and dealing with disputes among beneficiaries. In some cases, the beneficiaries can demand that the executor "pass accounts," or give an accounting of all receipts and payments from the estate.
